Terms & Conditions

1. Overview: These Terms and Conditions govern your subscription to our Web Design Maintenance Service. By subscribing, you agree to be bound by these terms.

2. Subscription Plans: You may choose from various subscription plans, each offering different levels of service. You choose to abide by the level of service offered with the plan selected. Details of each plan are available on our website. You can upgrade, downgrade, or cancel your subscription at any time.

3. Subscription Fees: Subscription fees are billed monthly on the second of every month. All fees are non-refundable, including in cases of cancellation or plan changes. If you elect to upgrade your plan within the month, we will send a separate invoice deducting the amount you already paid with your current subscription from the higher subscription plan you wish to upgrade to.

4. Automatic Renewal: Your subscription will automatically renew each month unless canceled. The payment method on file will be charged at the beginning of each billing cycle.

5. Cancellation: You may cancel your subscription at any time through your account settings. Your service will continue until the end of the current billing period, after which your subscription will not renew. At which point, you will be sent monthly invoices for only hosting fees, and yearly domain fees. Your website will still be hosted and operated in Wix.

 

6. Plan Changes: You can upgrade or downgrade your plan at any time. Plan changes will take effect at the start of the next billing cycle. No refunds or credits will be issued for downgrades.

 

7. No Refunds: All payments made are final and non-refundable. This includes fees for the current billing cycle in the event of cancellation or plan changes.

 

8. Service Availability: We strive to provide continuous service but do not guarantee uninterrupted access. Scheduled maintenance and unforeseen outages may occur.

9. Limitation of Liability: Our liability is limited to the amount you have paid in the last six months. We are not responsible for indirect, incidental, or consequential damages arising from your subscription or use of our services.

10. Changes to Terms: We reserve the right to modify these terms at any time. Any changes will be effective upon posting to our website, and continued use of the service after changes have been posted constitutes your acceptance of the new terms.

 

11. No Liability for Content: You are responsible for the accuracy, legality, and appropriateness of all content provided to us for inclusion in your website or branding materials. We do not accept any liability for:

  • Copyright infringement, plagiarism, or intellectual property disputes.

  • Misleading or false information.

  • Offensive or inappropriate content.
     

12. No Liability for Client's Business Operations: We are not responsible or liable for any decisions, actions, or outcomes related to your business operations, including but not limited to:

  • Business performance, sales, or revenue generation.

  • Legal compliance with industry-specific regulations or laws.

  • Customer relations, disputes, or reputation management.

  • Third-party interactions or partnerships.

 

13. Indemnification: You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of our services, including but not limited to:

  • Breach of these Terms and Conditions.

  • Violation of any applicable laws or regulations.

  • Any claims made by third parties regarding your website, social, branding, or business operations.
